What are Section 104 & 106 agreements?
Section 104 & Section 106 agreements of the Water Industry Act are two types of agreement between the site owner and a water company:
- Section 104 – It sets out that the owner of a property or site is entitled to have newly created drainage (or pupping station) adopted by the local water company.
- Section 106 – this agreement allows the owner of a site or property to connect drainage into the local public sewerage system. In certain parts of the UK, this triggers a Section 104 agreement.
Depending on the water company and the size of the development, these can be lengthy and complex negotiations.
Why can these agreements be so complex?
New schemes must adhere to the Sewerage Sector Guidance and the respective Design and Construction Guidance to be adopted by the respective water company.
As part of the connection and adoption process, developers are expected to provide the following:
- Technical drainage layout plans indicating sizes of pipes and SuDS features;
- Calculations and design of storage features, pipework capacity and flow controls;
- Technical detailed drawings of any complex engineered solutions;
- Pipework & manhole chamber schedules, including pipe sizes, gradients and bedding;
